Terms of Service

These Terms of Service apply to the use of this website and to services, workshops, training and educational materials provided by Katharine Brayne trading as Braynewaves (“Braynewaves”, “I”, “me” or “my”).

 

By using this website or purchasing a workshop or other offering where these Terms are referenced, you agree to the relevant terms below.

1. About Braynewaves

 

Braynewaves provides psychotherapy, EMDR, professional education, workshops, training and related services.

The information provided on this website is for general informational and educational purposes. Visiting this website, reading its content or contacting me through the website does not create a therapist–client relationship.

Where you enter into an individual therapeutic, professional or other contracted service with me, the terms specific to that service will be set out in your client contract or other written agreement. Where there is any conflict between these general website Terms and an individual contract relating to a service, the individual contract will take precedence in relation to that service.

2. Website information

 

I take reasonable care to ensure that information on this website is accurate and current. However, information may be updated or changed from time to time and I do not guarantee that all website content will always be complete, current or error-free.

Nothing on this website should be understood as individual psychological, psychotherapeutic, medical or other healthcare advice.

If you require individual support, you should seek advice appropriate to your own circumstances.

3. Therapy and individual services

 

Psychotherapy, EMDR and other individual services are provided subject to a separate client contract.

 

That agreement may contain terms relating to matters including fees, cancellations, confidentiality, communication, clinical boundaries and ending therapy.

 

The Terms on this webpage do not replace the terms of your individual client contract.

4. Professional and educational content

 

Workshops, training, presentations, articles, videos, downloads and other educational content provided by Braynewaves are intended for education, reflection and professional development unless explicitly stated otherwise.

Participation in educational services does not create a therapist–client relationship and is not a substitute for individual psychotherapy, medical treatment, clinical supervision or other professional support.

Where content is provided for therapists, counsellors or other practitioners, participants remain responsible for working within their own competence, professional scope of practice, ethical framework and the requirements of their relevant professional or regulatory bodies.

Nothing provided through a workshop or training should be interpreted as individual clinical advice or supervision concerning a particular client.

5. Intellectual property

 

Unless otherwise stated, the original content of this website and materials created and supplied by Braynewaves - including written material, teaching materials, slides, diagrams, graphics, workshop materials, videos, frameworks and resources - remains the intellectual property of Katharine Brayne / Braynewaves.

 

Content may be accessed and used for your own personal or professional learning but may not be copied, reproduced, republished, distributed, adapted, taught, sold, licensed or commercially exploited without prior written permission, except where permitted by law.

Any third-party materials remain the intellectual property of their respective owners.

6. The Survival Cascade®

 

The Survival Cascade® is a registered trademark and proprietary framework of Katharine Brayne.

 

The Survival Cascade® framework, including its associated teaching materials, diagrams, terminology and educational resources, may not be reproduced, adapted, taught, published, distributed, licensed, sold or commercially exploited without prior written permission.

 

Participation in a workshop or training involving The Survival Cascade® does not transfer ownership of the trademark, framework, methodology or associated intellectual property to the participant.

 

Where permission is expressly given to use particular materials within a participant’s own professional practice, that permission does not include the right to teach, train others in, reproduce or commercially distribute the framework unless separately agreed in writing.

Terms for Online Workshops and Training

 

The following additional terms apply when you purchase a place on an online workshop, webinar or training event directly from Braynewaves, including The Survival Cascade® workshop.

 

By completing your booking, you agree to these terms.

7. Your booking

 

Your place is confirmed once payment has been received and you have received confirmation of your booking.

 

Your booking is for you personally and should not be shared or transferred to another person without prior agreement.

8. Cancellations and refunds

 

Workshop bookings are non-refundable unless otherwise stated.

 

If you are unable to attend the workshop live for any reason, you will still receive access to the workshop recording following the live session.

 

No refund will be provided for cancellation or non-attendance.

 

Nothing in these Terms affects any cancellation, refund or other rights you may have under applicable UK consumer law.

9. If I need to cancel or reschedule

 

In the unlikely event that I need to cancel a workshop, you will be offered either:

  • a full refund of the workshop fee; or

  • the option to transfer your booking to a rescheduled date, where applicable.

 

If a workshop needs to be rescheduled, I will give you as much notice as reasonably possible.

 

Braynewaves is not responsible for additional expenses or consequential costs you may incur in connection with attending an online workshop.

10. Workshop recordings

 

Where stated at the time of booking, the workshop will be recorded and the recording will be made available to registered participants following the live session.

 

By attending a recorded live workshop, you acknowledge that your voice, name, image or contributions may be captured in the recording if you choose to speak, appear on camera, use the chat or otherwise participate.

 

If you would prefer not to appear in the recording, you may keep your camera and microphone off and should avoid including personally identifying information in any areas of the platform that are captured in the recording.

 

Please be mindful of your own privacy and the privacy of other participants when contributing.

 

Recordings are provided for the personal and professional learning of registered participants only. They may not be copied, shared, distributed, uploaded, sold, reproduced or made available to anyone who has not registered for the workshop without prior written permission.

11. Confidentiality and participation

 

Workshops may include discussion, reflection, questions and contributions from participants.

 

Participants are asked to respect the privacy of others. Personal experiences or identifying information shared by another participant should be treated as confidential and should not be shared outside the workshop.

 

While I will ask participants to respect these expectations, Braynewaves cannot guarantee the actions or confidentiality of individual participants.

 

Participants are responsible for deciding what personal information they choose to disclose in a group learning environment.

12. Technology

 

Online workshops will be delivered using the platform specified in the booking information.

 

You are responsible for ensuring that you have an appropriate device, internet connection and software required to participate.

 

Technical difficulties affecting an individual participant will not constitute grounds for a refund. Where a recording is included with the workshop, you will still receive access to it.

 

If significant technical difficulties on my side prevent the workshop from being delivered, I will arrange an appropriate alternative, reschedule the workshop or provide a refund where appropriate.

13. Workshop materials and intellectual property

 

All original workshop materials, slides, frameworks, teaching content, diagrams and associated resources remain the intellectual property of Katharine Brayne / Braynewaves unless otherwise stated.

 

The Survival Cascade® is a registered trademark and proprietary framework of Katharine Brayne.

 

Your booking gives you permission to use supplied materials for your own personal and professional learning.

It does not give you permission to reproduce, teach, publish, adapt, distribute, sell, license or commercially exploit The Survival Cascade® framework or other proprietary workshop materials without prior written permission.

 

Nothing in your participation in a workshop transfers ownership of any intellectual property, trademark, methodology or proprietary material to you.

14. Email communications and data protection

 

Your name, email address and other information reasonably required to administer your booking will be used to provide the service you have requested. This may include booking confirmations, joining instructions, reminders, workshop materials, important service communications and access to recordings.

 

Personal information will be handled in accordance with applicable UK data protection law and the Braynewaves Privacy Policy.

 

Where you have opted in to marketing, or where another lawful basis for electronic marketing applies, I may also contact you about future workshops, training and related Braynewaves offerings.

 

You can unsubscribe from marketing communications at any time using the unsubscribe option contained in those emails.

 

Unsubscribing from marketing will not prevent you from receiving essential communications relating to a workshop or service you have purchased.

15. Third-party platforms

 

Braynewaves may use third-party services to provide elements of its website, communications, payment processing, bookings or online workshops.

 

Your use of those platforms may also be subject to the relevant provider’s terms and privacy practices.

 

Further information about how your personal information is processed by Braynewaves and relevant third-party providers can be found in the Privacy Policy.

16. Liability

 

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

 

To the extent permitted by law, Braynewaves is not responsible for losses arising from reliance upon general educational or informational material provided through this website, workshops or training where that material has been used outside its intended purpose.

 

You remain responsible for your own professional decisions and for determining whether information or practices presented through educational content are appropriate for your circumstances or professional practice.

17. Changes to these Terms

 

These Terms may be updated from time to time to reflect changes to services, workshops, business practices or legal requirements.

 

The version published on this website at the time you make a booking will apply to that booking unless otherwise agreed.

18. Governing law

 

These Terms are governed by the laws of England and Wales.

 

If you are a consumer, you may also have rights under the mandatory laws applicable where you live which these Terms do not affect.
